Sales Terms and Conditions
All orders for goods accepted by www.everythingforit.co.uk ("the vendor") are accepted subject to the following conditions which shall form part and govern the contract of sale. Acceptance of goods shall be deemed to be acceptance of these conditions of sale. Any term sought to be imposed by a purchaser either in the document or otherwise that conflicts with or adds to these conditions is not accepted.
No agent or representative of the vendor has authority to vary these conditions unless accepted in writing by a director of Pacific Computers Ltd.
1 - Payment and Price
Prices shown are subject to prior sale, the vendor reserves the right to withdraw the offer at any time, subject to availability of stock.
2 - Availability of Goods
The vendor will use its best endeavours to comply with the date named for despatch or delivery which date is given and intended as estimate only and is not to be the essence of the contract. If owing to non-availability of the goods or any other causes beyond the vendor's control, the vendor shall be unable to effect delivery hereunder it shall be at liberty to determine the contract or part thereof by giving notice in writing to the purchaser. .
3 - Property And Risk
For so long as any amounts remain owing from the purchaser to the vendor (whether immediately due or not) title to the property of the goods shall remain in the vendor and ownership will not pass to the purchaser until the vendor has received payment in full. In the event of the purchaser reselling the goods, if the vendor has not received all amounts owing to it, the purchaser shall account to the vendor for the proceeds of any such sale and meanwhile will hold all proceeds of such sale of goods upon trust of the vendor until the vendor has received such amounts in full.
4 – Product Variation
Whilst the vendor makes every effort to ensure that goods supplied correspond in every respect with the sample, specification or description provided as the case may be, the vendor is not responsible for the minor variations in specification, in colour or other design features, and no such minor variation shall entitle the purchaser to rescind the contract or shall be the subject of any claim against the vendor by the purchaser.
5 – Guarantee and Claim Procedure
a) All goods carry a twelve month return to base warranty unless otherwise stated.
b) Where goods carry a manufacturers extended warranty it is the sole responsibility of the purchaser to liaise directly with the manufacturer of the product for full details of the warranty agreement.
c) Where goods are sold with an "on-site" warranty the terms of the warranty are provided separately and it is the sole responsibility of the purchaser to liaise directly with any third party or manufacturer as determined by the warranty.
d) The purchaser shall, unless otherwise stated in writing, be responsible for all expenses and incidental charges incurred during the warranty period.
e) The purchaser is obliged to notify the vendor of any DOA items (e.g. monitors or any other item covered by a manufacturer's on-site facility) within 48 hours.
f) No liability for any claim for damage or non-function ability shall be accepted unless the vendor is notified in writing by the purchaser within seven days of delivery. This period may be extended at the sole discretion of the vendor where the manufacturer's replacement policy exceeds this deadline.
g) No liability for any claim for missing items such as manuals, etc. shall be accepted unless the vendor is notified in writing by the purchaser within seven days of delivery.
h) No liability for any claim will be accepted in the case of goods differing in quantity or description from the particulars given on the delivery note unless the vendor is notified in writing by the purchaser within seven days of delivery and the onus is on the purchaser to prove any shortage.
i) In the case of active third-party on-site warranty/service facilities, the purchaser accepts an obligation to use the services of the contracted third-party to resolve claims under 5
j) In the case of manufacturers who operate direct product support and returns procedures, the purchaser accepts an obligation to process their claim directly through the manufacturer.
k) Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.
6 - Returned Goods
a) If the purchaser properly rejects any of the goods in accordance with the Distance Selling Regulations within seven working days in writing, the purchaser shall be responsible for the cost of returning the goods. Goods must be returned to by prior arrangement to; EverythingforIT, Unit 63-64 Tempus Business Centre, Kingsclere Road, Basingstoke, Hampshire, RG21 6XG Under the Distance Selling Regulations (2000) you have the right to cancel the contract relating to your order at any time up to the end of 7 working days after the goods are delivered. To exercise your right of cancellation, you will need to email info@everythingforit.co.uk or by letter or fax. Please provide details of the item(s) ordered and date received. Notification by phone is not acceptable. If you exercise your right of cancellation under the Distance Selling Regulations (2000) after the goods have been delivered to you, you will be responsible for returning the goods to EverythingforIT at your own cost, please note we strongly advise an insured service is used. EverythingforIT will also arrange collection of the item at a cost of £19.95 Inc VAT.
The Distance Selling Regulations (2000) places a duty on you to take reasonable care of the goods once you have exercised your right to cancel. Returned items must be adequately packaged. Please ensure all internal packaging, cables, manuals, drivers and protective bags, however small are included. EverythingforIT will refund you within 30 days for any sum that has been paid by you or debited from your credit or debit card for the goods. If after exercising your right under the Distance Selling Regulations (2000) you do not return the goods as required, EverythingforIT will charge you appropriate costs of recovering the goods. When exercising your right to cancel under the Distance Selling Regulations (2000) please return goods to EverythingforIT
Exceptions to Distance Selling Regulations (2000) - You do not have the right to cancel the contract under the Distance Selling Act if you have collected goods or if you are not a consumer i.e. a company, partnership, sole trader or any other commercial body or registered charity.
b) After 30 days if the returned goods received by the vendor are not in a condition where they can be sold as new then the vendor reserves the right to charge a 20% restocking fee. Whether goods are returned in a saleable condition is to be judged by the vendor.c) It is reasonable for the buyer to open the outer packaging and inspect the goods. It is not acceptable to break seals on any accompanying software or on the item itself.
d) Base units and computers built for individual specification are exempt from the regulation.
e) Business customers have no rights to returns goods under the regulation.
f) The order cancellation must be put in writing and must be forwarded to either info@everythingforit.co.uk or sent to returns at our head office address which can be found on the www.everythingforit.co.uk contact page.
g) All refunds will be processed within 30 days from when we receive notification of cancellation of the order.

i) If goods are to be credited / refunded the original carriage charge will not be.
7 - Consequential Loss
The extent of the vendor liability to the purchaser for any default or breach whatsoever or howsoever arising shall in no case exceed the invoice value of the goods and the vendor shall in no consequences whatsoever be liable to the purchaser in respect of any loss or damage whether suffered by the purchaser or any customer of the purchaser and whether direct, indirect, consequential or however else arising.
8- Law
If any part of these terms and conditions shall be found to be unlawful it shall not affect the validity or the enforceability of the remainder of the conditions. This contract is and shall deem to have been made in England and shall in all respects be governed by English Law. In respect of consumer sales only, statutory rights are unaffected by these terms and condition
